Terms of Service
These Terms of Service ("Terms") govern your use of the website at usetass.app (the "Site") and your purchase of TASS software (the "Software"). The Site and the Software are operated and sold by SIM DAD LLC, an Illinois limited liability company ("SIM DAD," "we," "us," or "our"). By using the Site or purchasing the Software, you agree to these Terms.
1. Who we are
SIM DAD LLC is an Illinois limited liability company. You can reach us at tass@simdadllc.com. More about the company is on the About page.
2. The Site
The Site describes TASS, publishes its pricing, and, from public launch, sells licenses to the GUI Edition. You may use the Site for lawful purposes only. We may update the Site's content at any time; product information on the Site describes the current release unless stated otherwise.
3. The Software and licenses
TASS ships in two editions. The Community Edition is open-source software provided under the Apache License 2.0; that license, not these Terms, governs your use of it. The GUI Edition is commercial software licensed under the TASS End User License Agreement (EULA). A GUI Edition purchase is a one-time payment for a perpetual license to the purchased major-version series, including all updates within that series. Later major versions may be offered as optional paid upgrades; declining an upgrade never disables the version you own.
4. Purchases, payment, and taxes
Prices are listed on the Site in US dollars. Payment is processed by our payment provider, identified at checkout, which handles the transaction and any applicable sales tax or VAT. By purchasing, you represent that the information you provide is accurate and that you are authorized to use the payment method. Discounted tiers (such as student pricing) may require verification of eligibility.
5. Refunds
Every purchase carries an unconditional 30-day money-back guarantee, described in the Refund Policy. The Refund Policy is part of these Terms.
6. Your data
The Software processes your text on your machine; we never receive your data or results. What little information the Site and the Software handle is described in the Privacy Policy, which is part of these Terms.
7. Intellectual property
TASS, the TASS name and logo, and the content of the Site are the property of SIM DAD LLC or its licensors. Open-source components and bundled dictionaries remain under their own licenses, which are listed in the product and its documentation. TASS-native dictionaries published under CC-BY-4.0 or ODC-BY may be used under those licenses, including commercially, with attribution.
8. Acceptable use
You may not use the Site or the Software to violate applicable law, to infringe the rights of others, or to attempt to disrupt or gain unauthorized access to our systems or those of our providers.
9. Disclaimer of warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIM DAD LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WARRANTY TERMS FOR THE SOFTWARE ARE STATED IN THE EULA.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIM DAD LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SITE OR THE SOFTWARE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Changes to these Terms
We may revise these Terms from time to time. Material changes will be reflected in the effective date above. Continued use of the Site after a change constitutes acceptance; purchases are governed by the Terms in effect at the time of purchase.
12. Governing law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law provisions. Disputes arising under these Terms shall be resolved in the state or federal courts located in Illinois.
